**1947 The Daphne Page Incident (update)

“What was it like to deal with omertà in Australia in the late 1940s? Fortunately, we have a pretty good idea. Jo Thomson’s (soon-to-be) husband Prosper (George) Thomson got involved in a court case where he was wedged between a lady called Daphne Page and a dangerous Melbourne individual who he would not name in court. The judge seems to have taken a hearty dislike to everyone involved, somewhat reluctantly judging the case in George’s favour but ordering him to pay the costs.”

Most true blue blooded Aussie utility enthusiasts should know that the classic ‘utility’ was invented (developed) by Lew Bandt of Ford (Aust.) in 1934. So how come a certain no first name Thomson of Ashgrove VIc. has a 1929 8 HP Triumph ‘utilty’ listed for sale in the Age? (7/3/40 & 8/3/40). Something rotten in Renmark if you get my drift Clive!

I suppose the questions might be…

Was Prosper as active in his wheeler-dealering in the immediate days/weeks/months after the discovery of SM?

Any abrupt changes in the frequency of his personal/business ads?

Any evidence that Prosper had begun to keep a lower profile, or even, “get out of Dodge”?

…and on another note I have to wonder again…

If Prosper or Harkness really did kill SM at their house, then why dump the body so close by when they seemingly had access to loads of motor vehicles

Guzz. You might be reminded that there was some rumour ten years ago on a semi reliable CM informant to the effect that Prosper ran some sort of shooting lodge out on on the ‘Coorong at Policeman’s Point’, not long after his? ad for weaponry in the form of a Mod. 63 Winchester pea shooter (not suited to big game hunting same goes for the earlier swap ad for a Savage 25 20). Nick Pelling was going to check the lead but we never heard back from him…?

Thomson had legit car yards in Adelaide, many of them, and high volume sales. No evidence of dishonesty.

Century Motors at 32 Main North Road, Prospect is still there and trading which was one of their many car yards. I seldom go to the north side of the city, but it was still there a few days ago when I went past. Whoever owns it now is still capitalising on the integrity of the name they established in 1950.

When you say “no evidence of dishonesty” no 1 , where would you expect to find such evidence at this stage?

There is plenty of evidence about Prospers dishonesty in his dealings dating back to before the war. In regards to his various car yards its hard to tell how honestly these yards were operated now. He seems to have been on the move quite often and its a bit hard 70 years down the track to know if this leopard changed his spots and became an upstanding businessman.

There were also looser laws back in the day to keep these used car salesmen in check. They got away with murder back in the day. Winding back odometers, bogging up dents etc. The industry became a cliche for general dodginess and all evidence suggests old Proper was captain dodgy.

Guzz Rating. Wasn’t Prosper that “got out of Dodge”, it was his Kansas born employers, the Burch bros. They had set up shop in Adelaide circa. 1920 before branching out to othe states, NZ plus the Cape Colonies, specializing in shonky door to door & mail order reproduction family portrait framing. ‘Empire Art’ was supported by ‘Universal Collections’ just like Dodge City stand over set up in the pre war days, before competition from out of state made things a tad too hot for country boys to make it pay.

    He won that civil case

She was trying to get twice the amount that the government of the day said the car was worth.

Packard was a very nice motor car. My father had one. It was considered an American Rolls Royce

I can understand why she wanted what it was really worth but the government decided otherwise and had pegged the value of it. She wanted him to enter into an illegal deal. She never loaned him money, that was a falsehood. Legally he didn’t have to pay her any more than the pegged price.

    No. 1,

Silly question but, why would Daphne Page “try it on” with a character like Thomson? Presumably, she was aware that a lot of car dealers were not exactly “Honest Joe” etc. And, the man from Melbourne, what was his agenda?

The government caused a problem by devaluing what people owned. She had a valuable Packard

Prosper pleaded guilty to falsifying Vic. papers for the old Willy’s and was subsequently bound over on a three (?) bond to be of good behaviour. There was no criminal conviction recorded, and it’s high time some folks became aware of that fact.

Prosper admitted fraud in WA and got a somewhat soft sentence possibly due to the fact that he threatened to top himself when he got caught red handed.

Whist Daphne Page failed in claim against Prosper its a stretch to say that he “won” the case. The judge was scathing of his behaviour in the matter.

Evidence about Prospers dodginess lingers long through many sources even 80 years down the line.

In the Missing Pieces documentary friends of “Jo” Thomson described Prosper in unflattering terms. Some spoke of his wheeling and dealing in later years as he became more small time and ended up running around garage sales and trying to flog second hand crap.

Youve got his convictions in Adelaide for running unlicenced Taxi and telling porkies in his adds.

The Daphne Page case spells his practices out in fine detaiI as does his WA fraud arrest and confession well covered in the WA papers at the time.

His was records is about as unflattering as you could imagine and suggests he was a malingerer.

He admitted to falsifying documents in a car fraud and received a 6 month good behavior bond as described in article in the West Australian on June 2 1938.

What penalty he received is irrelevant i,e if he managed to negotiate a no conviction recorded post serving a good behavior bond. So what.

He admits to car fraud in court and received a good behavior bond ,ergo the guy had form in fraudulent car dealings full stop.

The nurse has been called everything from a spy to a prostitute and everything in between for as long as I can recall simply because the phone number was in her name and not one of the many thousands of contributors over the journey has raised a single objection whist Prosper has blissfully sailed under the radar.

These above comments from Dusty and Dude, suggesting Prosper was quite prolific when it comes to defrauding people, makes me wonder if Prosper was the target of a hit that went tits up.

So…prolific scammer, Prosper, finally pissed off the wrong person and had to ” get out of Dodge”.

He leaves Melbourne for Adelaide but somehow the aggrieved chap finds his phone number.

He knows of a guy who has recently been down on his luck…work is scarce, split from the missus and is “on the bones of his arse” and offers him a few bob to find Prosper, get some recompensation money and, maybe “wisen him up” …if not, “neutralise” him

So, this bloke gets an Adelaide phone directory, and jumps on the Overlander where he has hours and hours on his hands to match this phone number to an address.

He doesn’t want any “comebacks” so takes no ID and removes tagging from his clobber…his tie is no problem because he lent it off his cousin who has a different surname…so who cares.

The fact that he discreetly kept this phone number in a copy of this book of crap poems…and that Harkness had, in recent years, given Boxall a copy of the same book is simply one of those synchronicity things.

Anyway…our man has made his way to Glenelg, found the address and therefore no longer needs the phone number…..Nonchalantly, he throws this book into the back of the nearest car that has an open window.

Prosper knows that it’s only a matter of time before he is tracked down and has already “prepped” Harkness as to what to do if the knock on the door comes ar a time when he is not home.

Harkness answers the door, let’s the stranger in and offers him a cuppa and a slice of pasty with a nastly little surprise in it.

Later that night they dump this guy on the beach…very sloppy really…but they are totally unaware that this guy, irritatingly, had a tiny piece of paper in his tab-pocket that would lead to the police knocking on their door.

This little scenario, of course, has a hundred holes in it and absolutely doesn’t explain the reason for the massive cover-up…..unless SM was quickly linked to the guy in Melbourne who was extremely “well connected”….

Prosper was able to convince Daphne Page to front him a considerable sum of money for his black market car deal.

She lived on South terrace in the square of Adelaide, so she was of means and apparently single. By my recollection Prosper had a car yard on Hanson st (which no loner exists) at the time which was walking distance from South terrace. He duded her. I don’t believe his cover story in court. Was he shagging her ? did he groom her knowing she was of means and somewhat vulnerable?

Prosper duded people and made the ‘you will be a sorry woman” threat to Daphne. So he gets her to front the cash does the deal, doesn’t pay her back and then threatens her. He denies none of this. So in short he was a piece of work and didn’t mind lying , commiting fraud and using threats. Talks about dangerous men in Melbourne he deals with.

SO yes Guzz I think he absolutely could have pissed of the wrong person

You ain’t set me straight on jack Dusty boy. He was a CONVICTED criminal old mate.

He was CONVICTED in WA of fraud. Only got a light sentence because he threatened to kill himself when he got caught red handed.

He was CONVICTED in Adelaide of running unlicensed taxi.

Judge Haslam slammed him and said in open court he wanted to refer him to the attorney generals dept.

He was a shonky car dealer who lied in his small adds shafted friends (Daphne Page) and treated his partner Jo’s friends like crap.

His WW2 service record was about as unimpressive as you can imagine and suggests he was a malingerer. But that didn’t stop him playing up his service record in his small adds. In case you don’t know exaggerating your service record is as big a slap in the face as you can make to REAL veterans. He played the system and even drew a war pension despite never having left Australia and spent most of his service time on sick leave.

    Pete

    Your wish is my command.

Where is the mention of the “individual [who] was thought to be a dangerous Melbourne criminal” who Prosper was afraid to name?

Dude said in an above comment:

“The nurse has been called everything from a spy to a prostitute and everything in between for as long as I can recall simply because the phone number was in her name and not one of the many thousands of contributors over the journey has raised a single objection whist Prosper has blissfully sailed under the radar.”

Well, in my second ever comment on CM on 10 August 2022 I wrote:

“Derek Abbott has confirmed that his wife’s grandfather is Prosper Thomson. Therefore all misogynists might like to consider stopping making comments that Jessica Thomson was a “slut”, prostitute etc. I think some commenters are still living in 1948. Shock horror! Baby born out of wedlock! Woman doesn’t marry father of child until his divorce papers come through! I need a brandy to calm myself down.

Prosper Thomson wasn’t Moriarty. He was a small-time car dealer/hire car operator who did a few dodgy deals. So what. He was swindled as many times as he swindled. And no evidence that Webb was a crook, however petty. I don’t believe that Oz in the late ’40s was the crime-ridden dystopia that some internet sleuths seem to think it was…”

Hate to see myself on the same page as Dusty. And while we’re talking about pages I also doubt that Prosper was “shagging” Daphne “Butcher” Page (nee Gibson) in 1947. When she died in 1950 she was 52 and seemingly happily married. From the ’tiser:

“PAGE (formerly Gibson). —On September 12, at hospital. Daphne Vervine, beloved wife of Noel [William] Page, of 125 Goodwood road. Goodwood, loving mother of Joy and Roma. Aged 53 [sic] years.”

In 1936 “Daphne Vervine Yells petitioned on the ground of desertion against Norry Charles Yells.” They had been married in Gawler SA. Daph went to school in Glenelg.

She was a dodgy dealer herself. When she was still married to her first husband she had a dispute with one Clara Maud Chalker. From the Perth Daily News December 1932:

“A woman’s invasion of Perth’s butchering trade, which lasted two years, had a disastrous ending, according to the story told when she was examined by the Official Receiver…in the Bankruptcy Court today.

Daphne Vervine Yells said that she owed four unsecured creditors £1766 l8s 8d and the funds at her disposal with which to meet the debts amounted to I8s 3d.

Mrs. Yells said that she opened the Model Meat Store in Hay-street Central in 1921), principally with money borrowed from Mrs. Chalker, a widow. Her husband conducted the People’s Meat Store in Wellington-street. She took a five years’ lease of the premises and the setting-up of the business cost altogether about £1800, the plant being acquired under hire-purchase. Mrs. Chalker lent her in all £924 13s 11d, without security, Mrs. Chalker being desirous of keeping the loan secret, as she did not want her children to know that she had made the investment.”

    https://trove.nla.gov.au/newspaper/article/82879660?searchTerm=%22daphne%20vervine%22

Back in the September Clara had been in trouble herself:

“Insulting Language. — For having used insulting language towards Daphne Vervine Yells on September 1, Clare [sic] Chalker was cautioned and ordered to pay £2/10/ costs.”

    https://trove.nla.gov.au/newspaper/article/32536482?searchTerm=%22daphne%20vervine%22

Daph was in Adelaide in 1941 with her new husband:

“Take the wife of Noel William Page, for instance. Her man was up for two years’ arrears In maintenance for another woman’s child. But Mrs. Page loved her husband, and put up a brave and poignant plea on his behalf.”

    https://trove.nla.gov.au/newspaper/article/76002451?searchTerm=%22noel%20william%20page%22

In March 1942 when Noel enlisted they lived in Melbourne – their address is given as St Kilda. On discharge in 1945 his address was given as East Malvern. Noel was a plasterer. They married on 7/6/41 and Noel died in May 1966 having remarried. All info from Noel’s NAA file.

That Prosper is being maligned ?

That Prosper was no more dodgy than thousands of other Aussies on the make. Take Oliver “Greedy Guts” Strang who Prosp tried to “defraud” in Perth in 1938.

The notorious Molloy Will Case – also in 1938 – in which Strang was embroiled paints him in a really bad light. Looks like he tried to swindle a large sum of money from a dying old man by getting him to sign a codicil to his will.

      “Mr. Justice Dwyer today refused

to admit to probate a codicil to the will

of the late Thomas George Anstruther

Molloy made in favor of Oliver Wilfred

      Strang…

The codicil provided for an absolute gift of

£6500 to Strang, and mentioned free of interest

loans to Strang of £20,000 “or more or any amount.”…

His Honor then dealt at length with

      the evidence submitted, concerning

Molloy’s health, and said that there

      were occasions when Molloy’s mental

      faculties were blurred.

At the time of the making of the

document Molloy did not have any in-

      dependent advice or assistance, and

there was some indication of Molloy’s

desire to refer the matter to his solici-

      tors…

“I have not been able to find that

      Strang’s testimony supports me in

taking a favorable view of the validity

of the document,” said his Honor. .

      “Strang’s silence regarding the docu-

ments after their signature, and his

      subsequent statements regarding what

had been done, and his somewhat hesi-

tant production of the documents at a

later date, indicate that he had in his

own mind a doubt of their validity.”

He was so desperate to get his hands on the filthy lucre that he took an appeal to the High Court of Australia in Melbourne.

“An appeal against this judgment, to

the High Court of Australia, was insti-

tuted by Strang, but subsequently nego-

tiations for a settlement resulted in the

deeds to which Mr. Justice Dwyer yes-

terday gave his approval. These docu-

ments embody not only the terms of set-

tlement concerning Strang (who is to be

paid £500 “in full satisfaction” of his

claims on the estate), but a settlement

      between all the parties.”

If the incidents with Strang and Page are the best you can come up with you ain’t making a very good case of proving Thomson’s “criminality”.

Why has nobody picked up on my find of an ad Prosper placed in the Age, MELBOURNE, in June ’47 to swop a house in Adelaide for one in MELBOURNE?

No worries lets ease up on Prosper.

The Melbourne connection to the dead guy identified by two witnesses as a Melbourne nitpicker. So what !

His strange change in fortune from month to month around that time and the plethora of small adds which had his phone number out to any and everyone from potential crooks to all manner of randoms. Doesnt explain a thing !

His past fradulant car dealings. So what because the time he got caught was the only time he did it !! and he got off with a good behaviour bond so it doesn’t count.

The unexplained items which just happen to be a car breakers standard tools of trade. The well documented interstate car thieving rings operating at the time. Prosper being a prolific dealer in second hand cars at the time and having form in vehicle fraud. Coincidence !

The connection to the Melbourne car ddealer “the type of person you don’t go to the police about” Irrelevant !!

For those who believe its Webb youv’e got the Melbourne connection being a tool maker and car industry connections all which have the potential to link Prosper from his Melbourne days.

Lets forget all that cos its unfair to have a go at old Prosper the war hero !!

Lets get back to the real story , was Jestyn in love with Alf Boxall and did she have a direct line to the Kremlin? I think were on to something there, and how about that micro writing !!!! amazing stuff.

At the end of the day SM had HER number in the ROK. The fact that Proper put all his shit in her name (like the Belair house) and would very likely have done the same with the phone because he needed a phone to run his bussness should be completely ignored.
